I was going East down Laketon Ave(but none of you know where that is so it really doesn't matter) and I see a cop coming towards me so I look down and see I'm going 30-35 and the speed limit is only 30. Didn't think much of it b.c it was only a max of 5 over. Well next thing I know the cop does a 180* in 3 lanes of traffic and he didn't know how to do them properly b.c he hit some water and totally spun out, gets behind me and pulls me over out of all the people that were around. GET THIS he walks up to my car and says "Can you tell me why you were doing 57 in a 30?" I was thinking ,WTF I was only going like 3 over and he pulls me over and tells me I'm going 27 over. What an ***. Not only was I not going that fast but there were 4 lanes of traffic 3 of which were passing me so I don't know how he decided to pull me over and tell me I was going 27 over the posted limit. It sucks being a girl. Thank goodness he didn't notice my turn signals b.c they are totally illegal lol. This is where you guys and girls come in. Now I need some pointers on how to get out of this b.c it will totaly screw up my insurance and I might have to get rid of the car b.c I won't be able to afford the insurance and the car payments. It really wasn't me ,I cross my heart and I promise to GOD that it wasn't. Not even I am that dumb to do 27 over in a place where there is a cop at almost every stoplight.

how many tickets do you have????

If you haven't gotten any tickets within' three years you can go to court and claim that your guilty with explaination and tell the judge that you'd like to claim the 3 year good driving record and they'll diss-miss the ticket....and i don't think it appears on your record either...
but you have to have a clean driving record for 3 years.....hope this helps

i don't know about going head on with a cop over a ticket,,,,,,you never know they might just show up,,,especially if they are as bad as in my area cops always show up for court.....your best bet is to do what i said....

I got pulled over for going 100 in a 40 zone and didn't get a ticket, the cop had to report to an accident. I also got pulled over for 50 in a 25 zone and didnt get a ticket, I was going about 60. HAHA.

I was pulled over going to work last Friday (2/16) and ticketed for going 83 in a 60. I swear I never got above 70-75. Since I really wasn't passing anyone, I told the cop that it wasn't possible for me to have been going that fast. He then said some BS about sparks coming from the left rear wheel of my car ('95 Probe GT) and he claimed my speedometer/odometer cable was loose. He then said he had records that in 1999 my car had over 130,000 miles on it, I was like W.T.F. and he then looked at my odometer and accused me of rolling it back (I had 126,200). I told him that this was total BS since I owned the car since it was brand new and I know for a fact that in 1999 I had under 100,000 miles on the car. I was so PO'd that he accused me of rolling back the odometer... hell, I can barely change the oil :).

Anyhow, from what I understand, moving radar is pretty inaccurate.

Another thing you could do is plead with the judge to take a defensive driving course. Upon completion of those, you get no points on your license, insurance rates don't go up. In fact some insurance companies offer a rate cut for taking a defensive driving class. You'll have to pay $40-$50 to go to the class (normally one 8-hour class or two 4-hour classes).

I've now had 19 speeding tickets in the past 6 years (this latest one was my first in two years). Only twice have I had points go on my record, but those are gone now. I've taken defensive driving 3 times. I'm 24, and my insurance rate on my new Sentra SE is $551/6mo (State Farm).

In your case, I'd speak with the judge and see if you can get in a defensive driving class. If not, ask for a continuance and get a lawyer.

BTW, even with a defensive driving class, you'll also have to pay the fine, but they will plea it down to a parking ticket.

Ok here are a few things to do. First try to remember the situation and write it all down, right now. Write down how many and what kind of cars were around you and where they were oreinted. Next thing you want to do is contact whomever pulled you over (local or state) and get the cops log book for that incident. He should have the exact situation written down in it.

When you go to court explain you were going the speed limit which sounds like you were. Explain what cars were around you and what they were doing. Be very exact when you are telling what the other cars were doing and what color the other cars were and so forth. If the log mentions nothing of the situation bring that up. If the cop shows and can't remember how he picked you out of all those cars it should be easy to get out of.

I say everything David said, and bring an attorney. This is a one time expense. Increased insurance rates and points on the license inflict expenses over YEARS. I say this because I went into a court situation with a great argument and tons of facts, but the judge didn't even look at me seriously without representation. Attorneys are better at it than you and me.

Oh Nismo_girl_2001, that totally sucks. I can't believe you got a ticket already. Totally crappy. I'd be choked too. Brand new car and ticketed, those guys are bastards.

I feel for you.

Take these poster's advice. Write down everything you remember, especially the part about you going nowhere near the speed he said you were, and how you weren't passing anyone. (Makes of the other cars if you can remember.)

I would also talk to one of the those traffic law places, they can help you out.

The cop probably won't even show, they only go to those things about 50% of the time. I know lots of people who go to challenge a ticket and they show up, wait 10min and get off because the cop isn't there to dispute the infraction.

Anyway, try not too worry too much. Where I come from you get one 'free mistake' per year, where your insurance doesn't go up if you keep it to that one ticket. Maybe it's the same where you are?

A couple of things:

1 - Write down everything you remember about this, and write it down now so you don't forget.

2 - Go to court. If you can't afford a lawyer, go anyway. Plead Not guilty, and ask for a trial. You are entitled to put the cop on the stand and question him about the whole thing. Make sure you ask him about his observation skills, etc.. Ask if he looked down at his radar gun, how can he be sure he got the right car, etc... Ask him where he was going to and where he was coming from, was he in a hurry, etc..


3 - Did the cop get you on radar? If he got you on radar you are entitled to ask for discovery of both the officer's radar certification to operate the radar gun, as well as the radar gun's calibration certification - if any of these are out of whack - you can have the case dismissed.

If he did not get you on radar, how did he know how fast you were going when he turned around? Cops have to pace you for at least a mile (in New JErsey at least) to be able to say that they caught you speeding by pacing. THat's 60 seconds, if you're going 60 MPH. That is actually a REALLY long time. You can ask him on the stand about all of that. Check the laws in your state - all the NJ traffic laws are on the web and fuly accessible - I'm sure your state has something similar. Check the statute he charged you under in the law listings.

When you go to court - dress appropriately. I have seen so many people in court dressed in jeans and t-shirts and the judge just looks at them and says "guilty!" - they tried by coming to court but they didn't take it seriously. Be serious, and dress well. It WILL make a difference

Finally - if the prosecutor is willing to drop the charge to a lesser charge - consider it. If it's to a 2 point (instead of 4 point) violation - consider it. Also consider asking to have it dropped to a no point violation if he'll go for it - something like "obstruction of traffic" might carry the same fine (so the town does not lose out on the revenue from the ticket), but give you no points. It can't hurt to ask.

Good luck and email me if you want more pointers my friends and I have gotten out of numerous tickets, just ebcause we went to court and actually had the nerve to put the cop on the stand.....

Oh and by the way - if he says he got you on radar and there were cars within 10 feet of you - that radar reading can be wrong. If you get to put him on the stand in this case ask him "how close was the car in front of me, behind me - in the other lanes" - and then ask "how can you be sure, that the radar gun was focused solely on my car?"

Was the traffic heavy? If so, he may not have clocked you - they need to have a full focus on you with no cars within 10 feet of you to make sure they have JUST YOU.

Also - any large trucks around would throw the radar off.

I highle doubt it is the truth but 100mph in a 40 zone should not equal a ticket, it should equal immediate loss of license and jail. That is asinine.
In addition, I don't believe current radar can be used in an oncoming traffic type of situation. Where the target vehicle and the radar applying vehicle are moving directly towards one another.

Ok well here is some more info for you all. This is my second ticket in 6 months. I have only had two total. The first ticket I went to court for and the cop actually showed up but he made a deal with me b.c he didn't know for sure if his radar was off. I had to pay the ticket and they dismissed it with no points and there is nothing on my record. And yes the cop yesterday was coming towards me 2 lanes over. He even wrote on my ticket heavy traffic so there is no way he could have gotten an accurate reading. I am definantly going to fight it b.c I don't want to lose my car. I love it.

Here's a thought for next time, because it sounds like there will be one. When you get stopped, be overly polite and admit you were wrong and apologize a bunch of times. This will work alot. I have been driving 40 years and the couple of times I got stoped for various things it worked. I thought my luck ran out a couple of years ago when I was stopped for speeding. But get this dude: Naturally I said all the right words, dont ever, ever, ever, ever argue or its over garanteed. He gave me a ticket for ***disobeying a sign****. No speading ticket no points no reporting to insurance- there was a fine though- Big deal. Hey cops are human, they go to work and support a family-most don't want to give out tickets. They respond to kindness.

Just a thought.

I have 12 tickets and over 30 written violations and i only have 1 point, so i am the one to listen to about getting out of a ticket, first don't pay the thing don't send in for a hearing, just wait for your court date to come in the mail, then what u do it write a letter to the court house to push back yoru court date,maje up some excuse like u have a doctors apointment, then they will send u another court date, again puch it back, do this 3 times. then show up for court this will be able a year later. cause of hwo long the system takes, by then the cop won't remember what the hell u did and won;t have any evidence against you, plead not guilty, he will say the state has no evidence against u and your case will cleared and no points on your record. No matter what the cop will show up, even since they puched it back they just put u with a bunch of other people that cop pulled over, if u are in the court room and the cop has evidence against. found information on how to fight tickets by typing in "speeding tickets" at yahoo.com, And the only reason i got the 1 point i have is because the judge asked me how many times i have been to court before and he got em there and gave me the point oh well 1 out of 18 isn't bad, Oh yeah since the cop was claiming that you were 27 over thats only 2 points u can pleade guilty and ask for leansy saying it was your first ticket and u will never speed again he will let u off with PBJ and u get no points hope this helps

tell him you want to see the radar # he used on your car, and there should be a record of the speed you were going on the gun memory. Take him to court and say it was a defoult radar gun, trust me it works ive done it 3 times!

N.o.B i dont; want to start anything but by law the officer doesn;t ahev to show u the radar gun, because by letting u get out of the car he is putting himself in danger, and by asking for the information on court the judge will barry u cause everyone tries to use that. if u want to try to nail the cop with with-holdig evidence as him what he got on his radar test, cause for a cop to use radar he has to pass the test, when the judge askes u for your reason on askign the officer that question, because if the cop got a 75% on the test its passing but still he didn;t knwo everything and when the cop can'; provide the evidence, the case is thrown out of court and no fine or points are recivied

That is why you need to request discovery of the OFficer's certification to use the radar, as well as the calibration records for the radar gun. You can also request discovery of ANYTHING about the officer - including his previous record. Just write a letter to the court clerk in the town where you got the ticket.

Be sure you are courteous and totally professional about this process. It really does help!
