It really depends on what state you live in. Here in AZ if you have OBD II vehicle they just hook up under the dash rather than hook you to the "sniffer".

If they hook you to a sniffer you may not pass. Although, I am pretty sure the precat is more for when the car is still cold and doesn't really do much once warm. That may just be my memory getting the best of me though, I can't say for sure. :D

The main cat is the one that takes care of the emissions so if you have a good cat on the car and have warmed the car up you may be alright.

I know here in Phoenix they make you shut the car off for like 3 minutes while they are doing the paperwork and a huge fan is blowing towards the front of your car.

I actually ran a sentra completely catless and still passed emissions with flying colors. This was because they just read the OBD II info rather than using a sniffer.

yea, if they only readout thru the obd2 port, it doesnt matter as long as your ses light is not on. hoever, if you live in another emission state, like cali, you should have the stock header for when you need to pass your smog and visual. if theres no visual, you will still need a cat to pass the 'sniffer' or other emission tests, where they test each exhaust gas percentage.

as long as you still have a good cat in your midpipe, you will still pass the 'sniffer', but you wont pass smog or visual inspections. the specv has cat on header and midpipe.

the precat was placed close to the motor so it will heat up faster, a cold cat doesnt do much. the downside is when the cat fails, its too close to the motor and can ingest ceramic particles, this is the specv and 2.5L problem. so, the closer the cat is to operating temp, the better it will clean the exhaust fumes. ideally, leaving the motor off for a few minutes should be ok, but actually slightly decreases the amount of pollutants the cat will capture.
